Thank you for choosing a Rivas Design product, we would like to familiarise you with the process of dealing with us, to ensure that your experience runs smoothly. Please feel free to speak directly with us if you have any questions. We are always happy to give advice on the product best suited to your needs.
Please take a few minutes to review these Terms and Conditions. Your purchase of products from us constitutes your agreement to follow these Terms and Conditions and to be bound by them. These terms and conditions and any contract including them is governed by the law of the state in which the seller accepts the buyers order and thus both submit to the jurisdiction of the courts of that state. (NSW) Our pieces are made individually and include hand forged and hand finished elements to provide a look that is unique to Rivas Design. Individual pieces may differ slightly and may vary over time with exposure to light and use. Natural imperfections are normal and may include evidence of the hand made elements. Products have a standard, one year warranty on manufacturing faults.
Rivas Design is not responsible for the condition of wrought iron that has been used inappropriately.
QUOTATIONS A quotation is not to be construed as an obligation to sell but merely an invitation to buy. There is no contractual relationship until the trader accepts the buyers order in writing and/or accepts a deposit / payment to proceed to supply the goods. The delivery cost is a guide only and will be confirmed at time of actual order.
CONTRACT (ORDER) DEFINITION A contract has 3 elements:- an offer (the item)
- an acceptance (the price, usually the signature accepting this and the terms and conditions)
- consideration (the money given in return for the goods)
ORDERING Your written purchase order and/or payments made is confirmation of your order is binding to the Rivas Design terms and conditions – we do not exchange or refund for change of mind, once orders have been finalised. CONDITIONS OF SALE Goods shall be paid in full prior to delivery / collection unless there is an agreement in writing between the purchaser and the vendor to do otherwise.
PAYMENTS Rivas Design accepts payment via direct deposit , bank cheques (once cleared) and cash payments. For custom designed work if a deposit has been paid, it will be taken as a contract having been entered into for the manufacture of the goods and will be binding.
ORDERS VIA INTERNET & PHONE (for goods ordered unseen) are to be paid by direct bank deposit or money order. Your written purchase request is a confirmation of your order and bound by our terms and conditions.
All goods remain the property of Rivas Design until paid for in full. Arrival / shipping times are quoted in good faith, but we are not responsible for unseen delays in manufacturing and shipping and we will endeavour to advise when such delays occur.
TRADE ORDERS For design professionals, we are can offer trade arrangements when supplied with appropriate business registration information. Ordering must be in writing from the landscape designers company. Payment is the responsibility of the designer. It is the responsibility of the designer to advise their client of the suitability (size, finish etc) of the product for their clients requirements.
PRICING AND PAYMENTS Pricing may change without notification. Rivas Design has the right to withdraw an item from sale at their discretion. Rivas Design is entitled to take action to recover the balance owing of an invoice. The client shall be responsible for any costs incurred by Rivas Design to recover this money including legal costs.
CANCELLATIONS AND REFUNDS we do not exchange or refund for change of mind.
CUSTOM DESIGNED ITEMS custom designed goods, are defined as individually made to clients order and are non refundable, if cancelled. (Unless the item is proved to be faulty, or has a serious flaw, that was not known at time of purchase.)
COLLECTIONS When collecting, the purchaser is responsible for checking condition of goods prior to leaving the premises – the care and responsibility is then with the purchaser.
DELIVERY and FREIGHT A competitive delivery service is available to most destinations through out Australia. The freight of all items is quoted individually. The client is responsible for all freight and handling charges for goods being sent. Rivas Design reserves the right to refuse delivery due to issues or concerns of access. We are not responsible for the installation of any products.
The condition of your Goods MUST be checked AT THE TIME OF RECEIVING the items. Please inspect your items when they are delivered by the courier before signing for their receipt. We will not be liable for any damage to any of the products unless we are notified at the time of delivery.
TERMS SPECIFIC TO ONLINE PURCHASES
PRODUCT COLOURS Colours as shown on our photographs are displayed differently on every monitor and computer system. As such, colours displayed should be considered a guide rather than an accurate representation of the actual finish.
PRIVACY POLICY The information that you have provided with this order (or quotation) may be used to produce a database for the marketing of our products. If you would prefer not to be included in such a database please advise us in writing.
